Terms of Service

(by our web site and by the physician who orders your testing)

I understand and acknowledge that by agreeing to use this website to seek testing services by referral to a qualified physician, that reading, understanding and acceptance of these conditions and terms of service are necessary.

1. I understand that I will be asked by the website for my demographic information and the nature of my requests for testing services. I must be truthful, as aliases are not accepted.
2. I understand that this web site serves as a resource for patients desiring certain medical screening and/or testing for certain diseases by referral to a qualified physician.
3. I understand that this web site does not participate in the practice of medicine and does not provide any diagnosis and/or treatment.
4. I understand that this web site has made arrangements for my referral to a qualified physician who is licensed and has prescriptive authority to order my testing in the state in which I will be tested.
5. I am 18 years old or older and I am the one to be tested.
6. I understand that the physician to whom I am referred, may, in his/her judgment, refuse to accept my referral for testing. Reasons for refusal may include but are not limited to the physician’s judgment that my requested testing is inappropriate for the circumstances.
7. I understand that testing for the presence of COVID-19 (SARS-CoV-2) IgG Antibodies means that I if I test positive that I may have been exposed to COVID-19 in the past and may have some immunity to further infections from COVID 19.

6. I understand that every effort will be made to have my test results available within 3 business days after collection. I understand that delays beyond three days may occur and sometimes require a re-collection of my sample if the laboratory is unable to perform the test.

8. I understand that it is my responsibility to contact patient services through this site if results are not retrieved or made available 3 business days after collection.
9. I understand that I cannot assume results are negative if I have not received my results.
10. I understand that if my results are positive that I will receive notification via email on the day the results are available. If my test is positive for COVID-19 antibodies, I will receive via email a  written explanation of what the test means and I will receive a phone call or videoconference call within 24 hours of notification of a positive result from the ordering physician or their designate to discuss the results and answer questions.
11. I understand that attempts to call and messages will be left for 4 consecutive days to discuss positive results and if unsuccessful, I will be sent a registered letter instructing me to call back.
12. I understand that the limit of the relationship that I make with the ordering physician is limited to the ordering of COVID-19 (SARS-CoV-2) IgG Antibody Testing and notification of results.
13. I understand that testing for the presence of COVID-19 (SARS-CoV-2) IgG Antibodies means that I if I test positive that I may have been exposed to COVID-19 in the past and may have some immunity to further infections from COVID 19.
14. I understand that testing might be available that tests for both COVID_19 IgG and IgM antibodies and I choose to test for IgG antibodies rather than seeking another source testing for both COVID-19 antibodies.
15. I understand that if I have a positive test or a false positive test that I still could still become infected with COVID-19 and transmit it to others.
16. I understand that the presents of COVID-19 antibodies (a positive test) does not guarantee that I have immunity or that I am not currently infected and contagious with COVID-19.
17. I understand that I can be without any symptoms of COVID-19 and still transmit COVID-19 to others.
18. I understand the testing for the presence of COVID-19 (SARS-CoV-2) IgG Antibodies is not used to diagnose or rule out a current COVID-19 infection.
19. I understand that if I have symptoms of COVID-19 such as shortness of breath, dry cough, fever, body aches, or sore throat, etc. that I should notify my healthcare provider by phone and not proceed to his/her office or other clinic unless you consider it an emergency. If considered an emergency, I should proceed to the closest hospital emergency department or call 911.
20. I am participating in this testing process voluntarily and understand that a visit to my personal physician to discuss findings is advised.
21. I understand that a copy of the final report of my laboratory will be made available to me or sent to the physician of my choice with appropriately prepared and signed medical information release documents at my request.
22. I further understand that by accepting referral to my assigned physician through the Kulbersh Health Screening Services, LLC physician affiliate network, and having the recommended testing, I voluntarily assume any risks associated with the screening process.  In addition, I hereby release and hold harmless, my assigned physician, the laboratory performing the testing, and any other persons or entities associated with this screening process from any and all claims, rights and causes of action arising from any injury or other damages or the consequences thereof, resulting from or in any way connected with the screening while on the Patient Service Center's premises or otherwise directly or indirectly arising from the transaction conducted through the services provided and/or though the relationship with my assigned physician.
23. By accepting these “terms of Service” for referral for testing, screening services, and or treatment requests and consultations, I hereby certify that I have read this entire document that I understand and agree to all of the terms and conditions. I knowingly and voluntarily use this acceptance as my consent for initiating a limited patient/physician relationship and for appropriate testing for COVID-19 Antibodies.
24. I understand that no lab tests are perfect and there is a chance that I could have a negative test for COVID-19 Antibodies even when I have had previous exposure to COVID-19 and might have immunity (a False Negative Test) or I could have a positive test and not have been exposed to COVID-19 and not have immunity. (A False Positive Test).
25. I understand that my results are made available online through a secure login unique to my order issued through secure site access which is assigned at the time of purchase.
26. I understand that this site’s ordering physician affiliate will be in compliance with federal, state, and local health reporting requirements.
27. I understand that this testing may or may not be covered by your health insurance or any government program and that I will be responsible for all filings for reimbursement of these fees.
28. I understand that the services provided the ordering site, physician affiliate or ordering physician do not constitute treatment or diagnosis of any condition, disease or illness. I am responsible for forwarding these results to my primary care or other personal physician and for initiating any follow up deemed necessary.
29. I understand that results of this testing and all informational material should be for informational purposes and not a substitute for my usual medical care.
30. I agree that these Terms of Services are construed under the laws of the State in which I reside and that if any portion is held invalid or unenforceable, the remainder shall, notwithstanding, continue in full legal force and effect.
31. I understand that there is much still much unknown at this time about the significance of COVID Antibody testing. Future research might show that there is no immunity to COVID-19 infections in patients who test positive and other discoveries that might be contrary to what is known or understood today.
32. I understand that Federal, State and local public health authorities have regulations that may require SARS CoV-2 IgG Antibody testing to be reported with my demographic information. The lab that performs my test and my physician will follow the regulations.
